Welcome: Understanding Our Terms

Please carefully review the following Terms and Conditions (“Terms”), which govern your relationship with La Rosa Negra Travel by Dream Vacations (“LRN Travel,” “we,” “us,” or “our”). These Terms constitute a legally binding agreement between you, the traveler (“Client,” “you,” or “your”), and LRN Travel with respect to all travel services, bookings, reservations, tours, and transactions (collectively, the “Services”).

By using our Services, submitting a deposit, or confirming a booking, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1. Binding Agreement for All Travelers

By booking with LRN Travel, you agree to these Terms on behalf of yourself and all members of your traveling party, including minors under your care (collectively, the “Client”).

You accept full responsibility for ensuring that all travelers in your party are informed of and agree to these Terms.

Franchise Disclosure

La Rosa Negra Travel is an independently owned and operated franchise of Dream Vacations. All travel services are arranged solely by La Rosa Negra Travel. Dream Vacations, its parent company, affiliates, officers, directors, employees, and agents do not own, operate, or control the day-to-day operations of La Rosa Negra Travel and shall not be held liable for any acts, errors, omissions, injuries, losses, accidents, delays, or irregularities arising from your travel arrangements.

2. Role of LRN Travel & Third-Party Suppliers

LRN Travel acts solely as an independent travel advisor and coordinator. We arrange travel services through third-party providers (“Suppliers”), including airlines, hotels, transportation providers, tour operators, and activity vendors.

  • Suppliers are independent contractors and are not owned, managed, or controlled by LRN Travel 
  • All services are subject to each Supplier’s own terms, conditions, and applicable laws 
  • LRN Travel is not liable for any acts, errors, omissions, delays, cancellations, overbooking, or negligence of any Supplier 

No refunds will be issued for Supplier-related disruptions, including delays, strikes, or cancellations.

You further agree that Dream Vacations shall have no liability for any claims arising from travel services arranged by LRN Travel.

3. Client Responsibilities

You agree to:

  • Provide accurate and complete information for all travelers 
  • Accept full financial responsibility for all bookings 
  • Ensure proper conduct throughout the travel experience 

LRN Travel reserves the right to terminate services without refund if a traveler engages in disruptive, abusive, unsafe, or inappropriate behavior.

Travelers under 21 must be accompanied by an adult age 21 or older.

4. Payments & Billing

  • Full payment or installment plans may be offered 
  • Bookings made after the final payment deadline require full payment at booking 

Final Payment

Failure to pay in full by the deadline may result in automatic cancellation without refund.

Late Payments

  • $50 fee for payments more than 14 days late 
  • Bookings 28+ days past due may be canceled without refund 

Requests to modify payment plans must be submitted at least 7 days before the next due date.

5. Cancellation Policy (Strict No-Refund Policy)

All cancellations must be submitted in writing.

All payments are non-refundable.

This applies to cancellations due to:

  • Personal reasons 
  • Medical issues 
  • Airline or supplier disruptions 
  • Government advisories 
  • Force Majeure events 

No exceptions apply unless explicitly stated in writing.

Travel insurance is strongly recommended.

6. Chargebacks

You agree not to initiate chargebacks except in cases of verified fraud.

Improper chargebacks may result in recovery actions, including legal fees, administrative costs, and outstanding balances.

7. Pricing & Availability

  • Prices are per person unless otherwise stated 
  • Prices are not guaranteed until booking is confirmed 
  • LRN Travel reserves the right to correct pricing errors 

All travel packages include a non-refundable agency service fee charged by LRN Travel for consultation, itinerary design, booking management, and client support services. This fee is earned upon payment and is non-refundable under all circumstances, including cancellation or itinerary changes.

8. Passports, Visas & Travel Requirements

You are solely responsible for all travel documentation, including passports, visas, and vaccinations.

LRN Travel is not responsible for denied boarding or entry due to improper documentation. No refunds will be issued.

9. Air Travel

LRN Travel is not responsible for airline operations, including:

  • Schedule changes 
  • Seat assignments 
  • Delays or cancellations 
  • Lost or delayed baggage 

Failure to use any flight segment may result in cancellation of remaining flights.

10. Changes & Itinerary Modifications

LRN Travel reserves the right to modify itineraries due to:

  • Weather 
  • Supplier changes 
  • Safety concerns 
  • Force Majeure 

No refunds will be issued for such modifications.

11. Force Majeure

LRN Travel is not liable for events beyond its control, including natural disasters, pandemics, war, government actions, or travel disruptions.

Refunds, if any, are subject solely to Supplier policies.

12. Health & Safety

You are responsible for your health, physical condition, medications, and dietary needs.

LRN Travel is not liable for medical emergencies or health-related incidents.

13. Optional Activities

Optional activities are not operated by LRN Travel and are undertaken at your own risk.

14. Travel Insurance

LRN Travel offers access to travel insurance through third-party providers. However, neither LRN Travel nor Dream Vacations is an insurance provider, broker, or underwriter and assumes no liability for insurance coverage, claims, or denials.

The purchase of travel insurance is optional but strongly recommended. You are solely responsible for selecting and understanding your coverage.

If you decline insurance, you accept full financial responsibility for any losses.

15. Unused Services

No refunds will be issued for unused services, including missed flights, late arrivals, early departures, or voluntary non-use.

16. Complaints & Claims

Issues must be reported immediately during travel.

Written claims must be submitted within 30 days of trip completion.

17. Website Use

LRN Travel is not responsible for website errors, third-party links, or technical issues.

18. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Texas.

All disputes shall be resolved exclusively through binding arbitration in Texas.

You agree:

  • Claims may only be brought against LRN Travel 
  • No claims may be brought against Dream Vacations 
  • You waive the right to jury trials and class actions 

19. Limitation of Liability

LRN Travel’s maximum liability is limited to the amount paid for your trip.

LRN Travel shall not be liable for indirect, incidental, or consequential damages.

To the fullest extent permitted by law, Dream Vacations shall have no liability for any claims arising from your travel arrangements.

20. Acceptance of Terms

By booking, you confirm that you:

  • Have read and understood these Terms 
  • Agree to be legally bound 
  • Accept responsibility for your travel party 

21. Waiver Requirement

All travelers must sign a Waiver of Liability, Assumption of Risk, and Indemnification Agreement prior to travel.

Final Note

These Terms constitute the entire agreement between you and La Rosa Negra Travel by Dream Vacations and supersede all prior communications.
